1Agreement to Terms

By accessing or using Thumblr ("Service"), operated by Moody Labs, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2Description of Service

Thumblr is an AI-powered platform that generates YouTube thumbnail images using Google AI technology. The Service allows you to create, store, manage, and optionally share your generated thumbnails.

3Account Registration

To use our Service, you must:

• Be at least 16 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4Subscription and Payments

4.1 Plans

We offer various subscription plans with different credit allocations and features. Current pricing and plan details are available on our billing page.

4.2 Payment Processing

All payments are processed securely through Lemon Squeezy. By subscribing, you agree to Lemon Squeezy's Terms of Service and authorize recurring charges according to your chosen plan.

4.3 Cancellation

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. You will retain access to paid features until the end of the period you've paid for. No refunds will be provided for partial billing periods.

4.4 Price Changes

We reserve the right to modify our pricing. If we change prices for your subscription plan, we will provide you with advance notice. Continued use of the Service after the price change constitutes acceptance of the new price.

5User Content and Intellectual Property

5.1 Ownership of Generated Thumbnails

You retain all ownership rights to the thumbnails you generate using our Service. You are free to use, modify, and distribute your generated thumbnails for any lawful purpose, including commercial use.

5.2 License to Thumblr

For thumbnails you mark as "public," you grant Thumblr a non-exclusive, worldwide, royalty-free license to display, reproduce, and use these thumbnails for marketing, promotional, and showcase purposes. Private thumbnails remain private and will not be used for such purposes.

5.3 Content Responsibility

You are solely responsible for the content you generate and any prompts you provide to our AI service. You represent and warrant that your use of the Service does not violate any third-party rights or applicable laws.

6Prohibited Content and Conduct

You agree not to:

• Generate or create content that is violent, graphic, or promotes violence
• Generate or create NSFW (Not Safe For Work) or sexually explicit content
• Use the Service to harass, abuse, or harm others
• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of others
• Attempt to circumvent any limitations or restrictions on the Service
• Use automated systems to access the Service without permission
• Impersonate others or provide false information

We reserve the right to remove content and suspend or terminate accounts that violate these terms.

7Service Availability

We strive to provide reliable service, but we do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or factors beyond our control. We are not liable for any damages resulting from service interruptions.

8Third-Party Services

Our Service integrates with third-party services including Google AI (Gemini), Lemon Squeezy, Supabase, and Cloudflare. Your use of these integrated services is subject to their respective terms of service and privacy policies. We are not responsible for the operation or policies of these third-party services.

9Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOODY LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or other harmful code that may be transmitted through the Service
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content

10Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR QUALITY OF THUMBNAILS GENERATED BY OUR AI SERVICE.

11Indemnification

You agree to indemnify and hold harmless Moody Labs, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.

12Account Termination

12.1 Termination by You

You may close your account at any time by contacting us at support@thumblr.io. Upon termination, your right to use the Service will immediately cease.

12.2 Termination by Us

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any other reason we deem appropriate. We will make reasonable efforts to notify you before termination, except in cases of serious violations.

12.3 Effect of Termination

Upon termination, your data will be retained according to our Privacy Policy. You may request deletion of your data by contacting support@thumblr.io.

13Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the French courts.

14Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date and, where appropriate, by email. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

15Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
